Welcome to PartyElite. These Terms of Service ("Terms") govern your use of our party planning and event organization services in Canada. By engaging our services or using our website, you agree to be bound by these terms and conditions.
1. Service Agreement
PartyElite provides comprehensive party planning and event organization services throughout Canada. Our services include but are not limited to event conceptualization, venue selection, vendor coordination, decoration planning, catering arrangements, and day-of event management. All services are provided subject to these terms and any additional agreements signed between PartyElite and the client.
By booking our services, you enter into a legally binding agreement with PartyElite. We reserve the right to decline service for any event that we deem inappropriate, illegal, or beyond our scope of expertise. All service agreements must be confirmed in writing and signed by both parties before work commences.
2. Booking and Payment Terms
All event bookings require a signed contract and a non-refundable deposit of 25% of the total service fee. The deposit secures your event date and initiates the planning process. Final payment is due 14 days before the event date. Late payments may result in service suspension or event cancellation.
Service fees are quoted based on the scope of work, event size, location, and duration. Additional services requested after contract signing may incur extra charges. All prices are quoted in Canadian dollars and include applicable taxes unless otherwise specified. Payment can be made via bank transfer, certified cheque, or approved payment methods.
3. Cancellation and Refund Policy
Cancellations must be submitted in writing. The following cancellation fees apply: 90+ days before event (deposit forfeited), 60-89 days (50% of total fee), 30-59 days (75% of total fee), less than 30 days (100% of total fee). Refunds will be processed within 30 business days of written cancellation notice.
In cases of force majeure (natural disasters, government restrictions, venue unavailability due to circumstances beyond our control), we will work with clients to reschedule events when possible. If rescheduling is not feasible, refunds will be calculated based on work completed and non-recoverable vendor deposits.
4. Client Responsibilities
Clients are responsible for providing accurate information about event requirements, guest count, dietary restrictions, venue accessibility needs, and any special considerations. Changes to event details must be communicated promptly and may result in additional charges or require contract amendments.
Clients must ensure all necessary permits, licenses, and insurance coverage are obtained as required by local regulations. PartyElite will provide guidance but is not responsible for securing legal compliance on behalf of clients. Final approval of all event elements must be provided by the client 7 days before the event date.
5. Liability and Insurance
PartyElite carries comprehensive general liability insurance for our planning services. However, our liability is limited to the total value of the service contract. We are not responsible for injuries to guests, property damage at venues not under our direct control, or losses due to vendor failures beyond our reasonable control.
Clients are strongly encouraged to obtain event insurance to protect against unforeseen circumstances. PartyElite is not liable for weather-related cancellations, guest no-shows, vendor service failures, or force majeure events that affect event execution. Our maximum liability shall not exceed the total amount paid for our services.
6. Vendor Relationships
PartyElite works with a network of trusted vendors including caterers, photographers, entertainers, and rental companies. While we carefully vet our vendor partners, we do not guarantee their services and are not liable for vendor performance issues. Direct contracts may be required between clients and certain vendors.
Vendor selections and arrangements are made based on client preferences and budget constraints. Final vendor agreements and payments are the responsibility of the client unless specifically included in our service package. We will coordinate vendor activities but cannot control all aspects of their service delivery.
7. Intellectual Property
All event concepts, designs, and planning materials created by PartyElite remain our intellectual property. Clients receive a license to use these materials for their specific event only. Photography and documentation of events may be used by PartyElite for marketing purposes unless explicitly declined by the client in writing.
Clients may not reproduce, distribute, or modify our planning materials for commercial purposes. Any custom designs or concepts developed specifically for a client event will be jointly owned, with PartyElite retaining the right to use general concepts for future events while respecting client-specific customizations.
8. Privacy and Confidentiality
We are committed to protecting client privacy and maintaining confidentiality of all event details, guest lists, and personal information shared during the planning process. Our full privacy policy is available separately and forms part of these terms by reference.
Client information will only be shared with vendors and venues as necessary for event execution. We implement appropriate security measures to protect personal data and comply with Canadian privacy legislation. Clients may request access to their personal information or its deletion subject to our record-keeping requirements.
9. Dispute Resolution
Any disputes arising from these terms or our services will be resolved through mediation or arbitration in the province where the event takes place, following Canadian law. Both parties agree to attempt good faith resolution before pursuing formal legal action.
These terms constitute the entire agreement between PartyElite and the client, superseding all prior communications or agreements. Modifications must be agreed upon in writing and signed by both parties. If any provision is deemed unenforceable, the remainder of these terms shall remain in effect.
